Terms of use

1. Service description

Test Buddy is a web service maintained by Mikko Mäkipää that can be used to create AI-assisted practice content for comprehensive school pupils. Pupils can use the exercises without registering. The service stores an anonymous student profile for progress tracking that is not linked to the pupil's identity — see the privacy policy for details.

The service is intended for independent exam practice. The main users are children’s guardians, who create exam-practice sets in the service.

2. User accounts and registration

Creating questions requires a main-user account. Creating a main-user account requires a valid registration code. By registering, you agree to provide correct information and keep it up to date.

You are responsible for keeping your account login details and the API key needed for the account confidential.

3. API key and AI services

The service forwards requests to an AI service (OpenAI or Anthropic) using your personal API key. You have a direct contractual relationship with the relevant service provider and are responsible for all costs charged by that provider.

Test Buddy stores the API key in encrypted storage and it cannot be read back in plaintext through the service. You cannot require Test Buddy to return the key to you; store the key yourself in a secure place.

You may not use the API key in a way that violates that service provider’s own terms of use.

4. Permitted use

You agree to use the service only for lawful and appropriate educational activity. The following, among other things, are prohibited:

  • using the service to produce offensive, misleading, or illegal content,
  • copying copyrighted text or other expression into the service without the rights holder's permission — for example, verbatim or near-verbatim reproduction of text or illustrations from textbooks or workbooks (Copyright Act 404/1961, section 2); describing topic areas, concepts, and learning content in your own words is permitted — copying protected expression is not,
  • intentionally increasing the number of AI requests in a way that causes unreasonable costs to third parties,
  • loading or disrupting the service’s technical infrastructure,
  • accessing other users’ data without authorization.

5. Content and intellectual property rights

The main user is responsible for the appropriateness of the content they create (question sets, topics) and for ensuring that it does not infringe copyright or other third-party rights.

Test Buddy’s operating model, code, appearance, and product name are the property of Mikko Mäkipää. Use of the service does not transfer any rights in them to the user.

Copyright protects the expression of a work — its linguistic or visual form — but not information, facts, or subject areas as such (Copyright Act 404/1961, section 1). The service’s AI generates practice questions based on subject-matter concepts and knowledge, not by reproducing source text. Temporary processing of source material during question generation occurs under section 11a of the Copyright Act and is not stored in the service’s databases. The user is responsible for not uploading material that contains directly copied protected text or other expression.

Copyright infringement notices

A rights holder or their representative can request removal of allegedly copyright-infringing content in Test Buddy by using the service’s removal notice form: submit a copyright notice.

The target response time is to review and respond to notices within 72 hours of receipt.

6. Service availability

The service is provided as is. The administrator does not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the service or parts of it without prior notice.

7. Limitation of liability

Mikko Mäkipää is not liable for indirect damage, such as an unexpected increase in API costs or loss of data, to the extent permitted by applicable mandatory law. Mandatory provisions of the Consumer Protection Act (38/1978) take precedence over these terms.

AI-generated content — important: Test Buddy uses AI models to create question content. AI models may produce incorrect, misleading, or inaccurate information (so-called hallucinations). Test Buddy does not guarantee the correctness, completeness, or suitability for educational use of questions or answers produced by AI.

Not an official curriculum source: Test Buddy is not an official system of the Finnish National Agency for Education or any educational institution. The service does not replace a teacher’s pedagogical assessment and does not provide official grades or learning certificates. The content is intended for independent practice — the main user is responsible for checking question sets before practice use.

The maximum amount of liability is the service fee paid or, if the service was provided free of charge, EUR 0. This limitation does not affect the consumer’s statutory rights (KSL 38/1978).

8. Account closure

You may request deletion of your account at any time by contacting the controller. The controller has the right to close the account if the terms of use are materially breached.

9. Changes to the terms of use

We may update these terms. Material changes will be announced by a notice shown in the service at least 30 days before the changes take effect. By continuing to use the service after the changes take effect, you accept the updated terms.

10. Governing law and dispute resolution

These terms are governed by Finnish law. Disputes will primarily be resolved through negotiation. A consumer has the right to submit a dispute free of charge to the Consumer Disputes Board for consideration. If the dispute cannot otherwise be resolved, it will be submitted to the competent district court for decision.
